Purchasing eligibility. You must be at least 18 years of age to purchase Services, Courses, and or Products. By purchasing Services, Courses, and or Products, you represent and warrant to Read Write Comprehend that you are at least 18 years of age.  If you are not at least 18 years of age, you may not use, and must stop using, the Services.  The Services are intended for use by residents of the United States only.  Read Write Comprehend does not represent that the Services are appropriate for use in all jurisdictions.  If you choose to use the Services outside of the United States, you do so at your own risk, and you agree that you will be responsible for complying with all applicable laws, rules, and regulations in all relevant jurisdictions. 

Usage eligibility. The use of Services, Courses, and or Products are intended for ages 5 years to 18 years. By using the Services, Courses, and or Products, you represent and warrant to Read Write Comprehend that you have permission from parental, guardianship, or similar adults aged at least 18 years.  If you do not meet these requirements, you may not use, and must stop using, the Services, Courses, and or Products. Read Write Comprehend represents that the Services, Courses, and or Products are appropriate for use in all jurisdictions.  If you choose to use the Services, Courses, and or Products outside of Singapore, you do so at your own choosing, and you agree that you will be responsible for complying with all applicable laws, rules, and regulations in all relevant jurisdictions. 

Changes to Terms.  Read Write Comprehend may change these Terms at any time by posting the updated Terms on the Site. You are responsible for checking the Terms for any changes.  By using the Services after updated Terms are posted on the Site, you agree to the updated Terms.  If you do not agree with the updated Terms, you may not use, and must stop using, the Services. 

Privacy.  Please read the Read Write Comprehend Privacy And Safety Policy, which also governs your use of the Services, Courses, and or Products, for information about how Read Write Comprehend collects, uses, and discloses your personal information.

Third-Party Services.  When you use the Services, you may also be using websites, website features and content, and other products, services, and applications, of one or more third parties over which Read Write Comprehend has no control (collectively, “Third-Party Services”).  For example, Read Write Comprehend uses a third-party payment provider, WordPress.com, Inc., to facilitate and process payments you make via the Services, Courses, and or Products.  Your use of Third-Party Services may be subject to separate policies, guidelines, terms, conditions, fees, and other requirements of the applicable third party (“Third-Party Terms”).  Read Write Comprehend makes no representations, express or implied, regarding Third-Party Services, including, without limitation, those concerning the truthfulness, accuracy, quality, or completeness of the Third-Party Services. You agree that Read Write Comprehend has no responsibility, and shall not be liable, for any matter related to any Third-Party Services.

License.  All content included in or made available through the Services, including, without limitation, text, graphics, logos, images, and software, are the exclusive property of Read Write Comprehend or its licensors, suppliers, or providers and protected by copyright, trademark, and other applicable laws.  Subject to your compliance with these Terms and any other terms and conditions applicable to your use of the Services, including any Third-Party Terms, Read Write Comprehend grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Services, Courses, and or Products.  All rights not expressly granted to you in these Terms, are reserved and retained by Read Write Comprehend or its licensors, suppliers, or providers. 

Your Account. If you create an account in connection with your purchase and use of the Services, Courses, and or Products, you are responsible for maintaining the confidentiality of your account, including your username and password.  You agree to provide current, complete, and accurate account information, and to promptly update such information, including your email address and credit card number and its expiration date, as applicable, so that Read Write Comprehend can complete your transactions and contact you as needed.  You agree that you will be fully responsible for all activities that occur in relation to your account.

Electronic Communications. You agree that all transactions and communications between you and Read Write Comprehend may be conducted electronically, including by email or through the Site. 

Your Content. When using the Services, you may provide Read Write Comprehend with comments, suggestions, ideas, questions, content, and other information related to the Services (your “Content”).  You grant Read Write Comprehend a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display Your Content throughout the world in any media.  You represent and warrant to Read Write Comprehend that: (i) you own all of the rights to Your Content; (ii) Your Content is accurate; and (iii) your and Read Write Comprehend’s use of Your Content you provide will not violate these Terms or any terms and conditions of any third party, including Third-Party Terms, or the rights of any person or entity.

Purchases and usage of Services, Courses, and or Products. Read Write Comprehend will attempt in good faith to deliver Services, Courses, and or Products ordered in accordance with your order, but will not be responsible or liable for any delays or failure in such delivery. Additionally, Read Write Comprehend services, courses and products; (iii) adjust scheduling, refuse, cancel, or limit services, courses and products inclusions; (iv)  and charge change, adjustment and or cancelation fees.  Services, Courses, and or Products will be delivered at the address specified when scheduling services, courses, and or products; provided, however, that Read Write Comprehend may not be able to deliver to addresses that are remote or otherwise difficult to deliver to.

Risk of Loss. Risk of loss and title for products purchased pass to you (the purchaser of the products) upon Read Write Comprehend delivery of the products to the carrier.

Prices and Taxes.  Read Write Comprehend reserves the right to determine prices for products and will make reasonable efforts to keep pricing information on the Site up to date. You (the purchaser of the products) are responsible for paying the price for the products purchased, as well as all applicable taxes, if any.

Information Provided via the Services. Read Write Comprehend attempts to be as accurate as possible.  However, Read Write Comprehend does not warrant that all information provided via the  Services, Courses, and or Products is accurate, complete, reliable, current, or error-free, including, without limitation, product descriptions, pricing, availability, shipping charges, and transit times. 

Changes to Services, Courses, and or Products.  Notwithstanding anything to the contrary in these Terms, to the extent permitted by applicable law, Read Write Comprehend reserves the right, in its sole discretion, to modify, discontinue, or suspend the Services, Courses, and or Products, including, without limitation, the marketing or sale of any product, product descriptions, and product prices.

Return Policy of Services, Courses, and or Products. If you received an incorrect service, course, and or product Read Write Comprehend will replace the incorrect or damaged service, course, and or product at no additional cost to you, provided that you: (i) email Read Write Comprehend at admin@readwritecomprehend.com about the incorrect or damaged product within two (2) calendar days after receipt; (ii) promptly provide Read Write Comprehend with any information reasonably requested in order for Read Write Comprehend to review and process your return, e.g. a picture of the incorrect damaged product; and (iii) return the incorrect or damaged product within three (3) calendar days after Read Write Comprehend provides you with return instructions.  Read Write Comprehend reserves the right not to require you to return the incorrect or damaged service, course or product.  All returned products must be unused and are subject to inspection, review, and acceptance by Read Write Comprehend.  Original shipping charges are not refundable.  Subject to the foregoing, ALL SALES ARE FINAL, ALL PRODUCTS ARE SOLD “AS-IS” AND ARE NOT RETURNABLE OR REFUNDABLE. 

Unauthorized Activities.  When using the Services, you agree not to: (i) use the Services, Courses, and or Products for any fraudulent or illegal purpose; (ii) harass, threaten, demean, embarrass, or otherwise harm any other user of the Services, Courses, and or Products; (iii) violate any right of a third party, including by infringing or misappropriating any third-party intellectual property right; (iv) interfere with the operation or features of the Services or any user’s enjoyment of the Services, including by uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code, reverse engineering or otherwise attempting to discover the source code of any portion of the Services, making any unsolicited offer or advertisement to another user of the Services, Courses, and or Products, collecting personal information about any third party without consent, interfering with or disrupting any network, equipment, or server connected to or used to provide the Services, tampering with or bypassing any security associated with the Services, Courses, and or Products, or using any robot, spider, scraper or other automated means to use the Services; or (v) attempt to engage in, or assist or permit any other person or entity to engage in, any of the activities described in this section and elsewhere in these Terms. This section provides examples and is not complete or exclusive.  Read Write Comprehend reserves the right to terminate access to, or withhold, any Services, Courses, and or Products, with or without cause, and with or without notice to you.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY. EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE SERVICES ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. READ WRITE COMPREHEND DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SERVICES, INCLUDING, WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. READ WRITE COMPREHEND DOES NOT WARRANT THAT THE SERVICES, COURSES, AND OR PRODUCTS WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

LIMITATION OF LIABILITY. IN NO EVENT SHALL READ WRITE COMPREHEND BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL CONSEQUENTIAL OR EXEMPLARY LOSS OR DAMAGE (INCLUDING, WITHOUT LIMITATION, LOSS OF USE, DATA, PROFITS OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE.  THE FOREGOING LIMITATION APPLIES EVEN IF READ WRITE COMPREHEND WAS ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE OR ANY REMEDY HAS FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT SHALL READ WRITE COMPREHEND AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SERVICES EXCEED THE AMOUNT YOU PAID TO READ WRITE COMPREHEND FOR THE SERVICE THAT IS THE SUBJECT OF OR GAVE RISE TO THE CLAIM.

Indemnification.  To the extent permitted by law, you are responsible for your use of the Services, Courses, and or Products, and you will defend, indemnify and hold harmless Read Write Comprehend and its officers, directors, employees, consultants, affiliates, subsidiaries, and agents from and against all claims, losses, damages, liabilities and expenses (including reasonable attorneys’ fees and costs of defense) arising out of or connected with: (i) your unauthorized use of, or misuse of, the Service; (ii) your violation of these Terms or any Third-Party Terms, including any representation or warranty; (iii) your violation of applicable laws, rules or regulations; (c) your violation of any third party right, including any intellectual property or privacy right; or (d) Your Content.

Force Majeure. Read Write Comprehend shall not be liable, nor be deemed to have defaulted under or breached these Terms, for any failure or delay in fulfilling or performing any obligation hereunder, when such failure or delay arises or results from acts beyond Read Write Comprehend reasonable control.

Governing Law. This Agreement shall be governed and construed in accordance with the laws of the country of Singapore, without regard to conflict of laws principles.
